Privacy Policy regarding personal data processing

We consider ensuring the right to personal data protection as a fundamental commitment of JJDisplay, as such, we will dedicate all the resources and efforts to process your data in full compliance with Regulation (EU) 2016/679 (“General Data Protection Regulation” or ” GDPR “), as well as any other applicable legislation on the territory of Romania. Since one of the key principles of this legal framework is transparency, we have drafted this document, by means of which we want to inform you about the manner in which we collect, use, transfer, and protect your personal data, when you are interacting with us in relation to our products and services, including by means of our web site or the application available on your mobile phone.

We reserve the right to periodically update and modify this Privacy Policy to reflect any changes to the way we process your personal data or any changes to your legal requirements. In the event of any such change, we will display on our website the modified version of the Privacy Policy, which is why we ask you to please periodically check the contents of this Privacy Policy.

Who we are and how you can contact us

JJDisplays is a J & J Group S.R.L. brand, legal entity of Romanian nationality, with headquarters in Bucharest, 140 Drumul Lunca Priporului, district 3, registered at the Trade Registry under no. J40/1038/2002, unique tax registration number RO 14450110 (hereinafter “JJDisplays” or “us“). For the purpose of the data protection legislation, we are classified as an operator, when we process your personal data.

The types of personal data we process

In general, we collect your personal data directly from you, so you have control over the type of information you provide us. For example, we receive information from you as follows:

When you create a JJDisplays account, you are sending us: your E-mail address, first and last name;

You can add additional information to your personal page (My Account) on the JJDisplays platform, such as: photo, gender, nickname, mobile phone number, home phone number, date of birth, education level, delivery addresses, alternative E-mail address, bank card data etc.;

When placing an order, you provide us with information such as the product you want, your first and last name, your delivery address, billing details, payment method, phone number, bank card details etc.

We also offer you the opportunity to register in the JJDisplays platform via your Facebook or Google account. If you opt for one of these options, you will be directed to a Facebook Admin / Google LLC page where they will inform you about the transfer of your data to JJDisplays. We can also collect and then process certain information about your behaviour while browsing our website or using your smartphone to personalize your online experience and make offers tailored to your profile. On our website and in the smartphone app, we can store and collect information in cookies and similar technologies, according to the Cookie Policy.

We do not collect or process in any other way sensitive data, included in the General Data Protection Regulation, under the special categories of personal data. We also do not want to collect or process data pertaining to minors who are under the age of 16.

What are the objectives and grounds for processing

We will use your personal data for the following purposes:

1. To supply JJDisplays services in your benefit.

This general purpose may include, as the case may be, the following situations:

a) Creation and management of the account on the JJDisplays platform;

b) Processing of orders, including their registration, validation, shipment and invoicing;

c) Resolution of cancellation or issues of any nature, relating to an order, to the purchased goods or services;

d) Return of products, as per the legal provisions;

e) Reimbursement of the product price, as per the legal provisions;

f) Ensuring support services, including herein answering your questions regarding your orders or JJDisplays goods and services.

Processing your data for these purposes is in most cases necessary for the conclusion and execution of a contract between JJDisplays and you. Certain processing underlying these purposes is also required by the applicable law, including tax and accounting legislation.

2. To improve our services

We always want to offer you the best online shopping experience. For this, we may collect and use certain information about your Purchaser behaviour, we may invite you to complete satisfaction surveys, subsequent to the completion of an order, or we can conduct studies and market research, directly or with the help of partners.

We base our activities on our legitimate interest in carrying out commercial activities, always taking care that your fundamental rights and freedoms are not affected.

3. For marketing purposes

We want to keep you informed about the best offers for the products / services you are interested in. In this regard, we may send you any type of message (such as e-mail / SMS / phone / mobile push / web push / etc.), which contain general and thematic information, information on similar or complementary products you have purchased, information about offers or promotions, information regarding the products added to the “My Account / Basket” section or “Request Quote” section or regarding products you have shown interest for, as well as other commercial communications such as market research and opinion surveys, and we can display personalized recommendations on your website and smartphone. In certain situations, we can base our marketing activities on our legitimate interest in promoting and developing our commercial activity. In any situation where we use information about you for our legitimate interest, we take care and take all necessary measures to ensure that your fundamental rights and freedoms are not affected. However, you may, at any time, request us, by the means described above, to stop processing your personal data for marketing purposes, and we will respond accordingly to your request.

4. To defend our legitimate interests

There may be situations in which we will use or remit information with the purpose of protecting our rights and commercial activity. These situations may include:

– Protection measures for the website and the users of the JJDisplays platform against cyber-attacks;

– Measures to prevent and identify fraud attempts, including here the remittance of certain information to the competent public authorities;

– Measures to manage various other risks.

The general basis of these types of processing is our legitimate interest in defending our commercial activity, being understood that we ensure that all the measures we take guarantee a balance between our interests and your fundamental rights and freedoms.

Also, in some cases, we base our processing on legal provisions such as the obligation to safeguard the goods and values provided by the applicable legislation in this field.

How long do we keep your personal data

As a general rule, we will store your personal data as long as you have an account on the JJDisplays platform. You may request us at any time to delete certain information or close the account and we will respond to these requests, subject to the storage of certain information even after the closure of the account, in cases where applicable law or legitimate interests impose it.

Whom do we send your personal data

As the case may be, we may send or offer access to some of your personal data to the following categories of entities:

– companies from the same commercial group as JJDisplays;

– courier services suppliers;

– payment / banking services suppliers;

– marketing / telemarketing services suppliers;

– market research services suppliers;

– insurance companies;

– IT services suppliers;

– other companies with which we can develop common offer programs on the market, in what concerns our goods and services.

If we have a legal obligation or if it is necessary to protect our legitimate interest, we can also disclose certain personal data to public authorities.

We ensure that access to your data by third party private law entities is done in accordance with the legal provisions on data protection and confidentiality of information, based on contracts concluded with the aforementioned.

In what countries do we transfer your personal data

Currently, we store and process your personal data in Romania.

Still, we may transfer some of your personal data to entities located in the European Union or outside the Union, including in countries where the European Commission has not recognized an adequate level of personal data protection.

We will always take steps to ensure that any international transfer of personal data is carefully managed in order to protect your rights and interests. Transfers to service providers and other third parties will always be protected by contractual commitments and, where appropriate, by other safeguards, such as the standard contractual clauses issued by the European Commission or certification schemes, such as the Privacy Shield for the Protection of Personal Data transferred from within the EU to the United States of America.

How do we protect the security of your personal data

We are committed to ensuring the security of personal data by implementing appropriate technical and organizational measures, according to the industry standards.

The transmission of your personal data is done using state-of-the-art encryption algorithms and the data is stored on secure servers, whilst ensuring data redundancy.

Despite the steps taken to protect your personal data, we note that the transmission of information via the Internet in general or by means of other public networks is not completely secure, bearing the risk that data may be seen and used by unauthorized third parties. We cannot be responsible for such vulnerabilities of systems that are not under our control.

What are your rights

The General Data Protection Regulation recognizes a series of rights with respect to your personal data. You may request access to your data, correct any mistakes in our files, and / or you can oppose the processing of your personal data. You can also exercise your right to complain to the competent supervisory authority or to a court of law. As the case may be, you may also have the right to request the deletion of your personal data, the right to restrict your data processing and the right to data portability.

In order to exercise your rights, you may contact us using the contact details listed above. Please note the following if you want to exercise these rights:

Identity. We take seriously the confidentiality of all records that contain personal data. For this reason, please send us your requests regarding such records using the JJDisplays e-mail address. Otherwise, we reserve the right to verify your identity by requesting additional information to confirm your identity.

Fees. We will not charge a fee so that you can exercise any right with respect to your personal data, unless your request for access to information is groundless, repetitive or excessive, in which case we will charge a reasonable amount in such circumstances. We will inform you of any fees applied before we resolve your request.

Response time. We plan to respond to any valid requests within a maximum of one month, unless this is particularly complicated or if you have made several requests, in which case we will respond within a maximum of two months. We’ll let you know if we’ll need more than a month. We may ask if you can tell us exactly what you want to receive or what you are worried about. This will help us to act faster and shorten the response time to your request.

Third party rights. We are under no obligation to respect an application if it negatively affects the rights and freedoms of other targeted persons.

Access You can request us to:

  • Confirm if we are processing your personal data;
  • Supply you with a copy of this data;
  • Give you other information about your personal data, such as what we have, what we use, who we divulge the data to, whether we transfer it abroad, and how we protect it, how long we keep the data, what rights you have, how you can make a complaint, the source from where we obtained your data, to the extent that the information has not already been provided to you by means of this information.
Rectification You may ask us to rectify or complete your inaccurate or incomplete personal data.

We may try to verify the accuracy of the data before correcting it.

Data deletion You may ask us to delete your personal data, but only in the following situations:

  • The data is no longer necessary for the purposes for which it was collected; or
  • You withdrew your consent (in case the data processing is based on consent); or
  • You enforce a legal right to oppose; or
  • The data was illegally processed; or
  • We have a legal obligation in this sense.

We do not have to comply with your request for deletion of your personal data if processing of your personal data is required:

  • In order to comply with a legal obligation; or
  • In order to notice, enforce or defend a right before a court of law.

There are certain other circumstances in which we are not obliged to comply with your request for data deletion, although these are the most likely circumstances in which we may decline your request.

Please note that prior to exercising this right, you should download from your JJDisplays account and save all JJDisplays orders, regardless of whether the billing has been made to you or to another person or entity (such as: invoices, guarantee certificates). If you do not do so before you exercise the right to delete, you will lose all of these documents and JJDisplays will be unable to provide these documents to you, as the case may be, because the data deletion process, namely the deletion of the JJDisplays account, with all the data and documents related to it, is an irreversible process.

Limiting  the extent of data processing You may ask us to restrict the processing of personal data, but only if:

  • The accuracy of the data is challenged (please refer to the Rectification section), in order to allow us to check the accuracy of the data; or
  • The processing is illegal, but you do not wish for the data to be deleted; or
  • The data is no longer necessary for the initial purposes it was collected for, but you need this data to notice, exercise or defend a right before a court of law; or
  • You exercised your right to challenge, and the verification which should show if our rights prevail or not is still currently pending.

We may continue to use your personal data following a restriction request if:

  • We have your consent; or
  • In order to notice, exercise or defend a right before a court of law; or
  • In order to protect the rights of JJDisplays or of any other natural person or legal entity.
Data portability You may ask us to provide your personal data in a structured, commonly used and readable form, or request that it be “ported” directly to another data operator, but in each case only if:

  • The processing is based on your consent or based on the execution of an agreement concluded with you; and
  • The processing is carried out automatically.
Challenge You may challenge at any time, for reasons related to your particular situation, the processing of your personal data, based on our legitimate interest, if you believe that your fundamental rights and freedoms prevail over this interest.

You can also oppose any time the processing of your data for direct marketing purposes (including creating profiles), without need to invoke any reason, in which case we will cease processing as soon as possible.

Automatic decision making You can request to not be the subject of a decision based solely on automatic processing, but only when that decision:

  • Produces legal effects which concern you; or
  • Affect you in another similar manner and to a significant extent.

This right foes not apply in case the automatically reached decision:

  • Is necessary for us to conclude or carry out an agreement with you;
  • Is authorized by the law and there are adequate guarantees for your rights and freedoms; or
  • It is based on your clear consent.
